Conventional warranty

The goods produced by ELBA ITALY S.p.A. (hereinafter referred to as “Elba Italy”) and bearing the De’Longhi trademark are covered by the legal warranty for conformity defects envisaged by Article 133 of Legislative Decree no. 206/2005 (Consumer Code).

In the two years following the purchase of the product, the consumer can therefore benefit from the legal warranty, which covers conformity defects existing at the time of delivery, by contacting the product’s dealer directly.

 

1. Conventional warranty

This document contains the warranty conditions acknowledged directly by the manufacturer – Elba Italy S.p.A. – with reference to its products. This guarantee is to be understood as a conventional guarantee within the meaning of Article 135-quinquies of the Consumer Code. The rights expressly provided for in favour of the consumer by the legislation on the sale of goods (Articles 128 to 135-septies of the Consumer Code) are in no way affected by this guarantee. Therefore, the consumer may always assert these rights against the retailer of the product, under the conditions and terms provided for in the aforementioned legislation.

2. Duration and Conditions of the Conventional Guarantee

Elba Italy guarantees its products against conformity defects existing at the time of delivery for a period of two (2) years from the date of delivery of the product. Conformity defects resulting from improper installation of the product or from transport damage are covered by this guarantee only if they are attributable to the direct responsibility of Elba Italy.

The consumer is obliged to prove, by means of a delivery document or a document valid for tax purposes (receipt or fiscal receipt) issued by the retailer, the date on which the product was delivered, the name of the retailer, the identification details of the product, the price, and that installation and transport are included in the agreements concluded with the retailer (in the event that the consumer requests warranty work for a conformity defect resulting from imperfect installation of the product or transport damage). For the guarantee to be operative, it is therefore necessary that the above-mentioned documentation be retained by the consumer and presented when the product is serviced. Elba Italy reserves the right to refuse to fulfil its obligations under this guarantee in the event that the document presented presents altered or deleted data after purchase.

specifying your personal data and those stated above for the purpose of product identification and purchase.

However, the guarantee remains subject to the following conditions:

  • the product must be used for domestic purposes and, in any case, not in the context of business or professional activities;
  • all installation and connection operations of the product to the electricity, water and gas distribution network must be carried out by qualified personnel and scrupulously following the instructions given in the installation instruction booklet as well as in the use and maintenance booklet supplied with the product;
  • all operations when using the product, as well as periodic maintenance, must be carried out in accordance with the prescriptions and instructions given in the operating and maintenance manual;
  • All product repairs must be carried out by authorised service centre personnel;
  • the spare parts, accessories and consumables used must be original ones only.

Once the guarantee period has expired, or if the guarantee does not operate for the reasons stated herein, the costs of any repair work shall be borne by the consumer.

3. Conventional Guarantee Exclusions

The following cases are excluded from this guarantee:

  • poor maintenance and failure to observe the instructions for proper operation of the appliance as set out in the manual supplied with the product; unsuitable, negligent and careless use; incorrect installation and/or connection to the supply and exhaust systems, where this is the fault of the consumer; supply and exhaust systems that do not comply with standards, are not properly maintained or which by their characteristics do not allow for proper installation;
  • transport or installation damage, where this is attributable to the retailer of the product and/or the consumer.

Also not covered by this guarantee are parts subject to normal wear and tear and any accessories and consumables, unless they are attributable to conformity defects.

This guarantee only covers conformity defects of the product and therefore does not cover periodic inspections and maintenance, as well as operation demonstrations. In the event that, at the consumer’s request, an intervention is carried out by service centre personnel in connection with the above, the costs of the intervention and of any spare parts shall be borne in full by the consumer.

4. Subject matter of the contractual guarantee

If, during the period of validity of the guarantee, a lack of conformity of the product is ascertained and acknowledged to exist at the time of delivery, the consumer shall be entitled to have the conformity of the product restored by repair or replacement.

It is understood that we will replace the product (with the same model or, if this is not possible, with another having equivalent or better characteristics), in lieu of repair, only if the latter is objectively impossible or involves disproportionate costs.

During the warranty period, in the event that the Authorised Service Centre determines that the malfunction is not due to a conformity defect, the consumer may be required to reimburse the cost incurred by the technicians for the inspection. This reimbursement will amount to a reasonable amount and will be indicated to the consumer in advance.

Unless proven otherwise, defects of conformity manifested within 12 (twelve) months after delivery of the product shall be presumed to exist on that date, unless this assumption is incompatible with the nature of the product or the nature of the conformity defect. Repair or replacement work does not extend the duration of the original warranty, which always runs from the date of delivery of the device.

5. Territorial extension

These conventional warranty conditions apply only to products purchased and used in the territory of Italy, including the Republic of San Marino and the Vatican City State.

6. Limitations of liability

Elba Italy declines all responsibility for any damage that may be caused, directly or indirectly, to persons, things and animals due to the failure to observe all the prescriptions indicated in the relevant instruction booklet and concerning especially the warnings on the subject of installation, use and maintenance of the product.
